Terms and Conditions
The following conditions govern the use of services and software provided by Dataforce Support AG (hereinafter "Dataforce").
1. Scope
These terms apply to all business relationships between Dataforce and the customer, unless otherwise agreed in the individual contract.
2. Contract formation
Contracts are formed upon written order confirmation by Dataforce or upon commencement of service delivery.
3. Prices & payment
All prices are in Swiss francs plus statutory VAT. Invoices are payable net within 30 days.
4. Service level
Cloud platform availability is 99.9 % per year.
5. Liability
Dataforce is liable solely for proven direct damages caused by intent or gross negligence. Liability is limited to the amount of license fees paid in the affected year.
6. Jurisdiction & applicable law
Swiss law applies, excluding conflict-of-law provisions. The place of jurisdiction is Bern.
